1. The Parties

This Rental Agreement is between The Tipsy Lime, LLC, based in Roanoke, Texas, and the Renter — the individual or organization booking the rental, whose details are provided at the time of booking. The Renter confirms they are at least 21 years of age and have the legal authority to enter this agreement.

2. The Rental

The Tipsy Lime agrees to rent the Renter a commercial dual-bowl frozen drink machine (the “Equipment”) for the event date and rental period selected at booking. The standard rental period is 24 hours unless extra rental days are added. The rental package, “The Tipsy Lime Experience,” includes:

• The dual-bowl frozen drink machine, delivered, set up, and picked up by The Tipsy Lime.
• Two flavor mixes from our menu (Classic Lime, Strawberry, or both).
• Cups, straws, and salt rims appropriate to the package.
• Basic operating instructions provided at setup.

3. Liquor Is Not Provided

The Tipsy Lime does not sell, serve, provide, or supply any alcoholic beverages of any kind. All alcohol used with the Equipment is supplied solely by the Renter. The Renter is solely responsible for the purchase, handling, service, and consumption of alcohol at the Renter’s event, and for compliance with all applicable federal, state, and local alcohol laws, including the Texas Alcoholic Beverage Code.

4. Payment, Deposit & Balance

• Package price: $299 per 24-hour rental (additional days at $100/day).
• Booking deposit: A non-refundable $100 deposit is due at the time of booking to reserve the Renter’s date.
• Balance: The remaining balance is due before delivery. The Renter authorizes The Tipsy Lime to charge the payment method on file for any balance, applicable delivery fees, taxes, or damages owed under this agreement.
• Delivery fees: Free delivery within 10 miles of Roanoke, TX. A reasonable, distance-based delivery fee applies beyond 10 miles and will be disclosed prior to confirming the booking.
• Returned-payment fees: The Renter is responsible for any chargeback or bank fees resulting from disputed or returned payments.

5. Cancellation & Rescheduling

• Cancellations made 7 or more days before the event date are eligible for a full refund of the booking deposit.
• Cancellations made within 7 days of the event are non-refundable; however, the Renter may reschedule one (1) time to a future date within 90 days, subject to availability.
• No-shows, locked-out deliveries, and inaccessible delivery sites are treated as same-day cancellations and are non-refundable.
• If The Tipsy Lime is unable to deliver due to circumstances within our control, the Renter will receive a full refund.

6. Delivery, Setup & Pickup

The Tipsy Lime will deliver, set up, and pick up the Equipment at the address and within the time window selected at booking. The Renter agrees to:

• Provide a complete, accurate delivery address and any access information (gate codes, parking, building access).
• Have an adult (21+) on site to receive delivery and sign for the Equipment.
• Provide a stable, level surface within reach of a standard 110V grounded outlet on a dedicated circuit.
• Allow access to the Equipment for pickup at the agreed time. Wasted trips, lockouts, or delays beyond 15 minutes may incur an additional service fee.

7. Renter’s Responsibility for the Equipment

From delivery until pickup, the Renter is solely responsible for the Equipment’s safekeeping. The Renter agrees to:

• Operate the Equipment only in accordance with the instructions provided.
• Keep the Equipment indoors or under cover when not in active use, away from rain, pools, sprinklers, and direct sun.
• Not move, disassemble, modify, or attempt to repair the Equipment.
• Not allow operation by anyone visibly intoxicated, by minors, or by anyone unable to follow basic instructions.
• Notify The Tipsy Lime promptly of any malfunction, damage, or loss.

8. Damage, Loss & Replacement Costs

The Renter is financially responsible for any damage, loss, theft, or excessive wear to the Equipment beyond normal use. The Renter authorizes The Tipsy Lime to charge the payment method on file for the actual cost of repair or replacement, including:

• Cleaning fees for Equipment returned excessively dirty or with non-approved substances.
• Repair charges for damaged parts (e.g., faucet, drip tray, side panels).
• Full replacement cost for total loss or theft of the Equipment, up to current market replacement value (approximately $2,500–$3,500 for the commercial dual-bowl unit).

The Tipsy Lime will provide an itemized statement of any damage charges within 7 business days after pickup.

9. Alcohol Service, Age, and Renter’s Liability

Alcohol consumption requires guests to be at least 21 years of age. The Renter agrees and acknowledges that:

• The Renter is solely responsible for verifying guest ages and refusing service to minors.
• The Renter is solely responsible for monitoring guest intoxication and refusing service to any visibly intoxicated person.
• The Renter assumes all liability for the actions of guests at the Renter’s event, including any harm or damage arising from alcohol consumption.
• The Tipsy Lime does not act as a server, caterer, or licensed alcohol provider, and bears no responsibility for the service or consumption of alcohol at the Renter’s event.

10. Indemnification & Hold Harmless

To the maximum extent permitted by Texas law, the Renter agrees to defend, indemnify, and hold harmless The Tipsy Lime, LLC, its owners, employees, agents, and contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) the Renter’s event; (b) the use, operation, or possession of the Equipment by the Renter or the Renter’s guests; (c) the service or consumption of alcohol at the Renter’s event; or (d) any breach of this Agreement by the Renter.

11. Limitation of Liability

To the maximum extent permitted by law, the total liability of The Tipsy Lime to the Renter for any claim arising from this Agreement is limited to the total amount paid by the Renter for the rental. The Tipsy Lime shall not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or lost enjoyment.

12. No Warranties; “As-Is” Equipment

The Equipment is provided “as-is.” The Tipsy Lime disclaims all warranties, express or implied, including any warranty of merchantability or fitness for a particular purpose. If the Equipment malfunctions through no fault of the Renter, our sole obligation is, at our option, to repair or replace it during the rental period, or refund a proportionate amount of the rental fee.

13. Weather, Force Majeure & Unsafe Conditions

Outdoor rentals are at the Renter’s risk. Rain alone does not cancel a rental, and rental fees are non-refundable due to weather unless The Tipsy Lime determines conditions are unsafe for the Equipment or our team (such as lightning, flooding, or severe storms), in which case we will work with the Renter to reschedule or refund where appropriate. Neither party is liable for any failure to perform due to events beyond their reasonable control, including natural disasters, power outages, government orders, or public health emergencies.

14. Photo & Video Release

The Renter grants The Tipsy Lime a royalty-free, perpetual license to use photographs and video taken of the Equipment at the Renter’s event for marketing purposes, including on our website and social media. The Renter may opt out by sending a written request to Info@Thetipsylime.com before the event.

15. Insurance (Recommended)

The Tipsy Lime recommends that Renters confirm their event venue’s liability insurance covers the gathering and any alcohol service. Event insurance is the Renter’s responsibility and is not provided by The Tipsy Lime.

16. Governing Law & Venue

This Agreement is governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising under this Agreement shall be resolved exclusively in the state or federal courts located in Tarrant County or Denton County, Texas, and the parties consent to the personal jurisdiction of those courts.

17. Entire Agreement; Modification; Severability

This Agreement is the entire understanding between the parties regarding the rental and supersedes any prior agreements, representations, or communications. Modifications must be in writing and signed (or electronically agreed to) by both parties. If any provision of this Agreement is found unenforceable, the remainder will remain in full force and effect.

18. Electronic Acceptance

By submitting a booking on this website, paying a deposit, or accepting delivery of the Equipment, the Renter confirms that they have read, understood, and agreed to these Terms & Conditions, and that electronic acceptance is the equivalent of a handwritten signature.
